Acceptance
These Terms form a binding agreement between you and 1521708 B.C. LTD. ("TrackE5", "we"). By creating an account or using the service you agree to them. If you do not agree, do not use TrackE5.
Eligibility
You must be at least 18 years old and able to form a binding contract. TrackE5 is offered in Canada and the United States only; we make no claim that it is appropriate elsewhere.
What TrackE5 is — and is not
TrackE5 imports, categorises and reports on your spending.
TrackE5 is not a bank, is not a money services business, and does not move, hold or transmit funds.
TrackE5 does not provide financial, investment, tax or legal advice. Categorisations, budgets, insights and projections are automated estimates provided for information only. You are responsible for your own financial decisions, and for verifying anything material against your bank's own records.
Your account
You are responsible for keeping your credentials secure and for activity under your account. Tell us immediately at security@tracke5.com if you suspect unauthorised access.
Bank connections
Bank connectivity is provided by Plaid Inc. and Flinks Technology Inc. When you connect an account you authorise us and our connectivity provider to access transaction information from your financial institution on your behalf. Your banking credentials are entered with Plaid or Flinks and are never received or stored by TrackE5.
Your use of Plaid or Flinks is also subject to that provider's own terms and privacy policy. We are not responsible for outages, delays or inaccuracies originating from Plaid, Flinks, or from your financial institution.
You may disconnect an account at any time.
Plans, billing and cancellation
TrackE5 offers a free plan and a paid Pro plan.
- The free plan is limited to 50 transactions per month and does not require a payment method.
- Pro is billed in advance on a recurring basis at the price shown at checkout, currently from CA$9.99 or US$6.99 per month. Prices shown on the web are exclusive of GST/HST/QST and US sales tax, which is added at checkout. Prices in the Apple App Store and Google Play are shown inclusive of tax, as those stores require.
- Pro renews automatically until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period and returns you to the free plan.
- Refunds. Subscription fees are non-refundable. You may cancel at any time and will keep access until the end of the period you have paid for. Purchases made through the Apple App Store or Google Play are refunded under those stores' own policies, which we cannot override. Nothing here affects your statutory rights under applicable consumer protection law, including the Quebec Consumer Protection Act.
- We may change prices on 7 days’ notice. Changes apply from your next billing period.
Acceptable use
You agree not to:
- use TrackE5 unlawfully, or to access financial accounts you are not authorised to access;
- reverse engineer, scrape, or attempt to breach or test our security without written permission;
- resell or provide the service to third parties except through family sharing as offered;
- upload malware or interfere with the service's operation.
Intellectual property
TrackE5, its software, design and brand are owned by us and licensed to you for personal use only. Your financial data remains yours. You grant us only the licence necessary to operate the service for you.
Disclaimers
To the fullest extent permitted by law, TrackE5 is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that categorisation will be correct, that transaction import will be complete or timely, or that the service will be uninterrupted or error-free.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
Limitation of liability
To the fullest extent permitted by law, our total liability arising out of or relating to the service will not exceed the greater of CA$100 or the amount you paid us in the twelve months before the claim.
We will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost savings, or financial decisions made in reliance on the service.
These limits do not apply to gross negligence or wilful misconduct, to personal injury or death caused by our negligence, or to fraud or fraudulent misrepresentation.
Nothing in these Terms excludes liability that cannot be excluded by law, including under the British Columbia Business Practices and Consumer Protection Act, the Quebec Consumer Protection Act, PIPEDA, and applicable US consumer protection legislation.
Indemnity
You agree to indemnify TrackE5 against claims arising from your misuse of the service or breach of these Terms.
Termination
You may close your account at any time. We may suspend or terminate accounts that breach these Terms, or where required by law, with notice where reasonably possible. On termination you must export your data before closing your account; no post-closure export window is offered.
Changes to these Terms
We may update these Terms. We will post the revised version here with a new date, and give at least 30 days’ notice of material changes. Continuing to use TrackE5 after they take effect means you accept them.
Governing law and disputes
These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law rules.
Disputes will be heard by the courts of British Columbia, and you and we submit to their jurisdiction. These Terms contain no arbitration clause and no class-action waiver. You are free to bring a claim in court, individually or as part of a class.
Nothing here deprives you of the protection of mandatory consumer law in your place of residence, or of your right to bring a claim in the courts of your own province or state where the law gives you that right.
